These Terms of Service (the "Terms") are a binding agreement between you and [Legal entity, TODO] ("PhoneVerify", "we", "us") governing your use of the phone number verification tool at businessphonenumberverification.com (the "Service"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

The Service

PhoneVerify is a data hygiene and validation tool. It takes phone numbers you submit and returns technical attributes derived from numbering rules and metadata, such as format and validity, country and dialing code, line type, carrier and timezone. A paid tier may include an optional live network lookup to confirm whether a line is currently active. Standard verification is passive: the Service does not place calls or send messages to the numbers you submit.

Acceptable use

You may use the Service only with phone numbers you are lawfully entitled to process. By submitting numbers, you represent and warrant that you have a valid lawful basis to hold and verify them and that doing so complies with all laws that apply to you, including data protection and telemarketing rules.

The Service is intended for data hygiene and validation, for example confirming that a number is well formed, identifying line type, and removing dead or invalid numbers from a list. The Service must not be used to evade Do-Not-Call rules, to circumvent consent or suppression requirements, or to enable unsolicited calls or texts.

Your contact obligations. Verification confirms attributes of a number; it does not establish consent to contact the person behind it. You remain solely responsible for compliance with laws governing how you contact people, including the US Telephone Consumer Protection Act (TCPA), Do-Not-Call registries, and equivalent rules in other jurisdictions. You are responsible for obtaining any required consent and for honoring opt-outs and suppression lists before contacting any number.

You also agree not to:

use the Service in violation of any applicable law or third-party right;
attempt to disrupt, overload, reverse engineer or gain unauthorized access to the Service or its infrastructure;
resell or sublicense the Service except as expressly permitted in writing.

Plans and fees

We offer a free tier and one or more paid tiers. The free tier may be subject to usage limits. Paid tiers unlock additional capacity and features such as unlimited bulk verification, live lookups and API access. Fees, limits and features for paid tiers are described at the point of purchase and may change for future billing periods. Paid fees are non-refundable except where required by law.

Accuracy and no warranty

The Service is provided on an "as is" and "as available" basis. Phone numbering data changes over time and verification results are best-effort estimates, not guarantees. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Service will be uninterrupted, error free, or that any result is correct or complete.

Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or relating to your use of the Service. Our total aggregate liability for any claim arising out of or relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim or one hundred US dollars.

Indemnity

You agree to indemnify and hold us harmless from any claims, damages, liabilities and expenses arising out of your use of the Service, the numbers you submit, or your breach of these Terms or of any law, including any claim that your contact of a number violated applicable telemarketing or consent rules.

Changes

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

Governing law

These Terms are governed by the laws of [Governing law jurisdiction, TODO], without regard to its conflict of laws rules. The courts located in that jurisdiction will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.
